BHP, Australia’s largest mining company, has been found liable for compensating victims of the catastrophic tailings dam collapse in Brazil that occurred in 2015. The disaster, which resulted in the deaths of 19 people, released millions of tonnes of toxic waste into a major river system and left hundreds of residents homeless. The incident is regarded as Brazil’s worst environmental disaster.

The Fundao tailings dam, part of a joint venture between BHP and the Brazilian company Vale through the Samarco project, collapsed on November 5, 2015. It devastated the community of Bento Rodrigues in Minas Gerais, leaving homes in ruins and leading to protracted legal battles over BHP’s responsibility for the disaster. After nearly a decade of disputes, the High Court in London ruled on October 6, 2023, that BHP is liable under Brazilian law for the dam’s failure.

Justice Finola O’Farrell, presiding over the case, stated, “The risk of the dam collapse was foreseeable.” This ruling paves the way for compensation claims from hundreds of thousands of affected individuals. BHP acknowledged the court’s decision and indicated it would appeal, stating that any assessment of damages would be determined in subsequent trials expected to conclude by 2028.

Since the dam’s failure, BHP has invested billions in remediation efforts and compensation initiatives in Brazil. The company reported that it has provided support to over 610,000 people affected by the disaster. Brandon Craig, BHP’s head of mining in the Americas, noted that 240,000 of those who received compensation are also claimants in the London lawsuit.
