UPDATE: A Sunbury farmer has been hit with a hefty fine of $10,175 following shocking revelations from an inspection conducted by the Environmental Protection Authority Victoria (EPA). This urgent development comes as officials discovered that Paul Attwell and his company, Active Farming, have been illegally burning industrial waste at their property on Riddell Road, Sunbury.

The EPA, responding to community complaints, conducted an inspection in October 2023. They found significant evidence of burn-offs and the illegal disposal of industrial waste. As a result, the EPA has issued an Environmental Action Notice mandating that Active Farming immediately cease all operations involving industrial waste, including burning and accepting new waste. Furthermore, all existing waste must be removed by January 30, 2024.

This enforcement action follows a recent ruling by the Victorian Civil and Administrative Tribunal (VCAT), which ordered an immediate halt to all activities at the site. The tribunal’s decision stems from a lengthy investigation by Hume Council, which had been addressing community concerns regarding excessive truck movements—over 300 trucks daily—disrupting local life along Canterbury Avenue.

Residents have expressed their frustration, reporting that the incessant truck traffic has severely impacted their quality of life. Many have taken their grievances to both the council and the EPA, demanding urgent action to halt these operations.

“The situation has been untenable for months,” one local resident shared. “We are relieved to see action finally being taken, but we need it to stick.”

Under the Environment Protection Act 2017 and the Infringements Act 2006, Attwell has the right to contest the infringement notice in court. However, the immediate priority for the EPA and local authorities remains to ensure compliance and restore peace in the community.
