UPDATE: A 65-year-old South Coast man stands accused of aggravated cruelty toward his dog, claiming the animal was suffering from cancer rather than neglect. David Duthie appeared in Bega Local Court on January 13, 2024, facing serious charges including failure to provide adequate food and veterinary care.

During the court proceedings, Duthie, who is representing himself, vehemently denied the accusations. He stated, “The dog was not starved; it was suffering from cancer,” a claim he hopes to substantiate with a witness. However, Magistrate Doug Dick urged Duthie to consider the legal implications of his defense, particularly regarding the evidence submitted by the Animal Welfare League.

Officials from the Animal Welfare League have provided a brief of evidence that includes expert testimony from a veterinarian and a police report. When asked if he would challenge this expert report, Duthie expressed his intention to seek a letter from his own vet, but Magistrate Dick clarified that such documentation would not suffice without the vet’s presence in court.

“If you’re going to be calling your own expert to rebut the claims, that expert is going to have to come to court,” Magistrate Dick stated.

Duthie, without legal representation, expressed concerns about the financial implications of bringing his vet to court. “I don’t have money to do that. All I can do is come here and tell you what happened,” he replied.

As the case unfolds, Duthie has requested the preservation of the dog’s carcass and any video evidence collected by police. Magistrate Dick advised him to direct such requests to the Animal Welfare League’s representative, Geoffrey Knox.
